Terms of service
The terms for using this website, and for subscribing to Divjyot ONE Cloud, our hosted service.
1. Who these terms are with
These terms are between you and Statistyx SolutionIT LLC ("we", "us"), [registered address]. If you accept them for an organisation, you confirm that you may do so for it, and "you" means that organisation. A signed agreement between you and us takes precedence over these terms where they differ.
2. The website
You may use this website to learn about Divjyot ONE and to contact us. Its content is provided for information; please don't copy it for other purposes, or try to disrupt it or gain access to anything not offered to you.
3. Your subscription to Divjyot ONE Cloud
A subscription gives you a Divjyot ONE instance of your own, hosted by us, on the plan you choose (Standard or Dedicated), for the people you authorise. You're responsible for who you give access to, through your identity provider or the accounts we host for you, and for what they do in it.
4. Your data
- The data you put into Divjyot ONE is yours. We use it only to provide the service to you, and as our privacy notice and our data processing terms describe.
- You can export all of it at any time while your subscription lasts, and for [period] after it ends.
- When your subscription ends and that period has passed, we delete your instance and its data. Backups expire within 35 days after that.
5. Acceptable use
Don't use the service to break the law, to store data you have no right to, to try to reach other customers' instances or our systems beyond your own, or to test its security without our written agreement. We may suspend access that puts the service or other customers at risk, and will tell you why.
6. Fees and payment
Fees are as quoted, or as shown when you subscribe, and are paid in advance through Stripe or as invoiced. If a payment fails and isn't made good, we may suspend your instance until it is; your data is kept while it's suspended. [Taxes, price changes and refunds.]
7. Availability and support
We work to keep the service available and to apply upgrades with as little disruption as we can, and we tell you in advance of planned maintenance that interrupts it. [Service levels and support hours, as agreed.]
8. Security
We protect the service and your data as our security page describes. If we learn of a breach affecting your data, we'll tell you without undue delay.
9. Confidentiality and ownership
Each of us keeps the other's confidential information confidential. We own Divjyot ONE, its software and this website; you own your data. Feedback you give us we may use to improve the product.
10. Warranties and liability
[Warranties, their exclusions, and the limits on each party's liability.]
11. Ending a subscription
You may end your subscription at the end of any billing period. Either of us may end it if the other seriously breaches these terms and doesn't put it right within 30 days of being told. Sections 4, 9 and 10 continue after it ends.
12. General
These terms are governed by the laws of [jurisdiction], and disputes go to the courts of [venue]. If we change these terms, we'll tell subscribers [notice period] ahead; changes apply from your next billing period.
